Terms of Use

These terms were drafted as relatively comprehensive and may cover more than Servd Live will offer or require at the outset. We drafted the terms this way to provide some future proofing to help potentially avoid the need for constant updates to these terms as Servd Live rolls out additional features. For example, certain of these terms are drafted to cover interactive portions of a website, for example, where users could comment on videos or text, post questions, or use forums. If Servd Live will not have interactive portions these terms could be removed so that the entire document could be trimmed down. However, if Servd Live will in the future have interactive portions, we recommend including the applicable terms from the outset to help future-proof.

Please note certain green highlights in the terms. These are where Servd Live needs to include a contact email or other contact information, for how consumers can contact Servd Live about questions about the terms or their membership.

These terms include arbitration provisions. Arbitration can be cheaper and less public than traditional legal disputes. Please let us know if you would like to discuss the inclusion of the arbitration provisions.

Privacy Policy

We prepared a starting point privacy policy based on our knowledge of the Servd Live website and functionalities. Like the terms, there are certain green highlights in the privacy policy where Servd Live will need to include contact information.

There are only limited state and federal privacy regulations at this time in the U.S., including in California and Washington, and additional states, including New York, may have regulations on the way. Many of the state regulations apply not just to companies based in the relevant state, but to companies which do significant business and data processing for residents of the state. This policy is currently not drafted for compliance with any specific state regulations. However, as Servd Live grows the company may become subject to certain state regulations. It will be necessary to update the privacy policy and audit Servd Live’s privacy practices to ensure compliance.

Disclosures Regarding Terms of Use, Privacy Policy, and Re-Marketing

The privacy policy includes a disclosure that Servd Live may use data received in connection with event sign-ups for re-marketing purposes, re-marketing either by Servd Live or by Servd Live’s partners.

We also recommend that a disclosure be included on the membership subscription and event sign-up pages, that by subscribing as a member the user will be subject to the Terms of Use and Privacy Policy, and that by registering for an event the user will be subject to the Terms of Use and Privacy Policy and that Servd Live and Servd Live’s partners may re-market to the user.

We prepared the following two disclosure to include on the membership subscription page and event registration pages:

Subscription Disclosure

“By subscribing as a member of Servd Live, you agree that you have read and agree to be subject to Servd Live’s Terms of Use and Privacy Policy.”

Event Registration Disclosure

“By registering for this event, you agree that you have read and agree to be subject to Servd Live’s Terms of Use and Privacy Policy, and that Servd Live, and our partners, may use the information provided with this registration for re-marketing purposes.”
